LEVEL OF ASSISTANCE REQUIRED TO LOAD AND UNLOAD YOUR CARGO?
-Keep in mind that PGT is a transport company, we are not a moving company. Our transport service will include 1 driver, 1 truck and 1 trailer. We are willing to help/assist loading your cargo as needed, but within certain limits. We carry commercial transport insurance, this is not the same type of insurance moving company carry to cover their employees. Our employees are not allowed to lift over 50 lbs, enter customer residences, package goods, etc.
SPECIAL REQUEST?
- PGT will secure your cargo/vehicle to ensure there is not damage during transport. If you would like additional services included such as blanket wraps, tarps, etc. there will be additional cost involved and these services should be requested before the quote is accepted.
ACTS OF GOD?
- PGT has no control over the weather or ACTS of GOD. At times there may be situations outside of our control such as rain, snow, traffic delays, etc. If it rains during loading and unloading, your items may get wet prior to them being wrapped or tarped or our driver may be a late due to unexpected traffic, in any case, the driver will communicate the situation with the client. We hope you understand.
This agreement is between the customer and his/her duly authorized agent, (hereinafter referred to as “Customer”), and Patton Gregory Inc. dba PG Transit, hereinafter referred to as PG Transit.
Customer agrees to and authorizes PG Transit to transport the vehicle(s), cargo and/or freight described in the Bill of Lading/Shipping Order.
1. PG Transit will pick up and deliver Customers vehicle(s), cargo and/or freight to the location/address described in the Bill of Lading/Shipping Order. PG Transit  will attempt to deliver as close to the desired location Customer requested as long as it is within county, city, state and federal legal and safety rules and regulations. An alternate, mutually agreed upon location to load or unload may be necessary due to low hanging trees, low hanging wires, narrow streets, and residential area restrictions.
2. PG Transit shall provide Customer with an estimated pick up and estimated delivery date and time which will be listed on the Bill of Lading/Shipping Order. However, delays may occur prior to, and/or during transport due to weather, road conditions, mechanical problems, etc. There are no guarantees regarding pick-up or delivery times and dates. PG Transit shall not be held responsible for loss or damages resulting from delays of any kind or for any reason including car rental fees and/or accommodation fees. PG Transit shall not be held liable for the failure of mechanical or operating parts of Customers vehicle(s), cargo and/or freight.
3. Customer authorizes PG Transit to jointly and separately operate and transport Customers vehicle(s), cargo and/or freight between the pick-up location and the delivery destination set forth in the Bill of Lading/Shipping Order.
4. Customer agrees to prepare the vehicle(s), cargo and/or freight for transport. All loose parts, fragile accessories, low hanging spoilers, etc. must be removed or secured in advance. Customer shall remove all non-permanent outside mounted luggage and other racks prior to shipment. Vehicle(s), cargo and/or freight must be tendered to PG Transit in good running operating condition (unless otherwise noted). Any part of the vehicle(s), cargo and/or freight that falls off during transport because Customer failed to properly secure them will be Customer’s responsibility including damages caused by said part to any vehicles(s) and/or person involved.
5. Customer must disarm any alarm system installed in vehicle(s), cargo and/or freight or provide proper instructions to disarm alarm system if need be. In the event said alarm sounds and there are no keys or instructions to turn it off, PG Transit may silence the alarm by any means necessary (such as disconnecting the power source).
6. Luggage and personal property must be confined in the trunk of the vehicle only, with no heavy articles exceeding 100 lbs. PG Transit are not liable for personal items left in vehicle(s), cargo and/or freight, nor for damage caused to vehicle(s), cargo and/or freight due to excessive or improper loading of personal items. UNDER NO CIRCUMSTANCES SHALL ANY OF CUSTOMERS PROPERTY INCLUDE, BUT NOT LIMITED TO Explosives, Guns, Ammunition, Flammable Products, Narcotics, Negotiable and Legal Papers, Alcoholic Beverages, Jewelry, Furs, Money, Live Pets, Live Plants, or any unlawful contraband. Customer agrees that PG Transit may dispose of said items with no reimbursement due to Customer. PG Transit shall not be held responsible for delivery of personal property. If Customer wishes to put items in vehicle(s), cargo and/or freight, he/she does so at his/her own risk.
7. Relating to International Orders, vehicle(s), cargo and/or freight must be empty except for factory installed equipment, the must indicate serial number(s), and provide vehicle(s), cargo and/or freight approximate value in U.S. dollars. The Customer is responsible for any/all customs paperwork. Customer may ask PG Transit for guidance with properly preparing customs documents prior to shipping but PG Transit shall not be held responsible for incorrect documentation.
8. If vehicle(s), cargo and/or freight is inoperable or oversized, including but not limited to dual or oversized wheels and tires, extra-large racks, etc. Customer will incur additional charges, therefore Customer must inquire as to extra charges PRIOR to PG Transit arriving for pickup. If PG Transit is not advised of inoperable or oversized/modified vehicles prior to pick-up, all extra charges must be paid in cash or money order upon delivery.
9. Once PG Transit agrees to pick up and transport Customer’s vehicle(s), cargo and/or freight, PG Transit will notify the Customer via email (the email address provided by Customer on the Transport Request Form/Bill of Lading).
10. If the Customer cancels his/her order prior to receiving an email confirmation of order acceptance (Approved PG Transit Shipping Confirmation/Bill of Lading), any payments made to PG Transit (if applicable) will be refunded in full. However, if the Customer decides to cancel his/her order after PG Transit has emailed Customer acceptance of the order and assigned a driver (Approved PG Transit Shipping Confirmation/Bill of Lading), a $150 cancellation fee will be applied.
11. The Customer agrees that PG Transit has the right to reject any order for any reason at any time.
12. At the time of pick up, Customer and PG Transit will carefully inspect the vehicle(s), cargo and/or freight for pre-existing damage (exterior only) by completing a vehicle inspection report. PG Transit and Customer will both acknowledge the condition of the vehicle(s), cargo and/or freight and Customer will sign and receive a copy of the bill of lading.
13. At the time of delivery, Customer and PG Transit will carefully inspect the vehicle(s), cargo and/or freight for damages during transport. PG Transit and Customer will both acknowledge the condition of the vehicle and Customer will sign and receive a final copy of the bill of lading.
14. All damage must be noted in the proper place on the Bill of Lading and signed by Customer regardless of weather conditions, time of day or day of the week. Signing the Bill of Lading without notation of any damage verifies that Customer has received their vehicle(s), cargo and/or freight in satisfactory condition and that PG Transit are relieved of any further responsibility. PG Transit damage claims are covered by a minimum of $300,000 public liability and property damage. All claims must be submitted in writing within 24 hours of delivery. PG Transit will share insurance policy details upon request.
15. PG Transit accepts responsibility of vehicle(s), cargo and/or freight after pre-inspection is done and the Bill of Lading is signed by the Customer. PG Transit responsibility will end when the vehicle is delivered and Customer signs the Bill of Lading after final inspection.
16. PG Transit will not be responsible for damage caused by acts of God, hail or storm damage, or damage resulting from worn/broken parts of Customers vehicle(s), cargo and/or freight.
17. The Customer shall, in their absence, designate a person to act as their agent at the point of pick up and/or delivery, if for any reason they are unavailable. This assigned agent will have the power and authority of Customer to complete inspections of vehicle(s), cargo and/or freight and sign the Bill of Lading.
18. PG Transit is not responsible for covering any auction storage fees or pickup/delivery facility storage fees. Customer agrees to pay all storage fees prior to pick up of the vehicle(s), cargo and/or freight. Should Customer be unable to accept delivery for any reason, the vehicle(s), cargo and/or freight will be placed in storage. Any and all storage and re-delivery charges will be the responsibility of the Customer.
19. Customer warrants that he/she will pay the transportation price/deposit due to PG Transit, for delivered vehicle(s), cargo and/or freight, and will not seek to charge back a credit card or stop payment of a check to offset any dispute for damage claims and/or delays, etc. It is the Customers responsibility to have any payment due when PG Transit arrives for pick-up. All payments to PG Transit must be in the form of an approved uShip Code, Cash, Cashier’s Check or Money order – No exceptions. Certified funds must be made payable to PG Transit. Personal checks nor credit cards will be accepted for the remaining balance - No exceptions!
For Customer utilizing the uShip Payments program: Customer (Shipper) must provide an original print out from their uShip website account with the generated payment code for the shipment directly to the driver.
The Customer agrees that if the payment cannot be made by these approved methods, the vehicle(s), cargo and/or freight will be stored at the Customers expense until Customer pays all transport charges in full. Should the Customer be unable to accept delivery for any reason, the vehicle(s), cargo and/or freight will be placed in storage and any/all storage and delivery charges will be the responsibility of the Customer.
20. This Agreement shall be construed in accordance with the laws of the State of Georgia.
21. The parties here agree that all actions or proceedings arising in connection with this agreement shall be tried and litigated exclusively by the State Court of Cobb County in the State of Georgia, or Federal Court (if permitted by law and a party elects to file an action in federal court).
This choice of venue is intended by the parties to be mandatory and not permissive in nature and to preclude the possibility of litigation between the parties with respect to, or arising out of, this Agreement in any jurisdiction other than that specified in this section. Each party waives any right it may have to assert the doctrine of forum non-convenience or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this section by action of this provision, the parties agree to submit to the personal jurisdiction of the aforementioned court.
This supersedes all prior written or oral representation of PG Transit and constitutes the entire agreement between Customer and PG Transit and may not be changed except in writing signed by an officer of PG Transit.
